Introduction:
The Smart Building Store is an electronic platform owned by Dream Adventure for managing electronic portals, registered in the United Arab Emirates under license number 1074607.
These terms and conditions regulate the relationship between the merchant, the consumer and the Smart Building Store with regard to the services provided. Registration and approval of these terms constitutes an acknowledgment by the user of accepting all the terms of the agreement and his commitment to its instructions. This agreement becomes effective once the user approves it and begins registration in the Smart Building Store.
The introduction is an integral part of this agreement and includes the following definitions:
The Smart Building Store: means the electronic platform owned by Dream Adventure, which allows the display and marketing of suppliers’ products to consumers electronically.
The consumer: the person who makes the purchase through the electronic store.
The merchant: the approved supplier registered as a commercial entity according to the laws of the Department of Economic Development in Dubai, or any other jurisdiction.
The service provider: the service provider such as shipping companies and electronic payment gateways that contribute to the completion of sales operations.
Article One: The relationship between the merchant and the Smart Building Store
The merchant undertakes upon registration that he is a commercial entity subject to the regulations and laws of the Department of Economic Development in Dubai, or the United Arab Emirates, and that he meets all legal requirements.
The merchant shall bear the legal consequences in the event of his failure to comply with what is stated in the previous paragraph.
The merchant shall be responsible for any violation of the regulations of the UAE and shall bear sole responsibility before government agencies and consumers.
The merchant shall abide by all e-commerce laws, including the Cybercrime Law, the E-Commerce Law, and the Intellectual Property Rights Law.
The merchant must submit the official documents required by the Smart Building Store, such as the national identity, commercial register, and tax registration certificate.
Displaying the merchant’s products on the platform does not mean that the Smart Building Store is committed to completing sales operations.
The merchant must update product data regularly to ensure the accuracy of the information provided to the consumer.
The merchant shall bear responsibility for the confidentiality of his account data and sales data.
The Smart Building Store is committed to maintaining the confidentiality of the merchant’s information in accordance with the approved privacy policy.
The Smart Building Store has the right to suspend or freeze the merchant’s membership in the event that he provides inaccurate information or violates the agreement.
The official means of communication between the two parties shall be email or signed mail.
The financial relationship between the merchant and the store shall be determined by an agreed profit margin or commission.
The Smart Building Store shall deduct the agreed commission for each purchase and transfer the amount to the merchant’s account within 30 days.
Article Two: The merchant’s relationship with the consumer
Purchases between the merchant and the consumer shall be an independent contractual relationship, as the Smart Building Store shall act as a marketing intermediary. The merchant shall be obligated to issue the necessary invoices for these transactions.
The store shall provide appropriate payment methods to facilitate purchase and payment processes between the consumer and the merchant.
The consumer shall provide the store with the required purchase information (name, email, phone, delivery address).
In the event that the product is out of stock, the merchant shall compensate the consumer with an alternative product or refund the full amount.
The merchant shall be obligated to issue an invoice to the consumer and attach it to his control panel on the platform.
The store shall retain the consumer’s data to facilitate future purchases.
The consumer has the right to review his purchases before receipt to ensure that they conform to the specifications.
The merchant must provide high-quality, non-counterfeit products, and is responsible to the authorities and consumers for any violation.
The store receives complaints related to the goods and transfers them to the merchant to deal with them.
The store is not responsible for disputes between the merchant and the consumer, and its role is limited to mediation.
The store does not guarantee that the products are free from defects.
The merchant is committed to determining the exchange and return policy for its products in accordance with the e-commerce laws in the UAE.
Article Three: The merchant’s relationship with the service provider
The Smart Building Store provides multiple services to support sales operations, such as marketing, logistics, payment and delivery services through external providers.
The Smart Building Store is not responsible for the actions of service providers, but rather is limited to the role of linking the merchant with service providers.
The merchant agrees to share its necessary information with service providers in accordance with the privacy policy.
The store provides electronic payment services through approved gateways to facilitate the rights of the parties.
The store has no control over the actions of third parties or other sites linked to the store.
Article Four: General Provisions
The Smart Building Store reserves the right to amend this agreement at any time, and notify the concerned parties thereof.
The store has the right to use the information provided by the merchant for marketing purposes.
All contents of the store are owned by the merchant and may not be used without written permission.
The Smart Building Store acts as an intermediary between the merchant and the consumer and emphasizes the need to protect personal data as much as possible.
The terms of the agreement apply to all promotional publications and materials published on social media platforms.
Disputes between the parties are resolved through friendly negotiations, and in the event of a continuing dispute, recourse is made to the competent courts.
This agreement may not be modified or canceled except by a decision of the Smart Building Store management.
